LEGALITY OF PRE-OWNED SOFTWARE LICENSES.
IN EUROPE
The legality of the sale and purchase of software licenses is based on the Exhaustion Principle and the EU Software Directive 2009/24 ratified in the European Court Judgment in 2012 (Judgment of the Court of the CJEU (Case C-128/11 -3 July 2012).
This judgment clarifies that a user who has purchased a software licence can re-sell it, as he is the owner of the licence, under the following conditions that must be fulfilled in order to apply the exhaustion of the distribution right:
Licenses must be perpetual
(not subscriptions)
First time on the market
must be in Europe/EEA
There must be a financial payment
For licences
Previous owners
must have uninstalled it
The new owner
must accept the terms
